German version below. Conditions of participation for the “Bring your Roomie” bonus program 1. Provider information, scope of application The recommendation program “Bring your Roomie” is an offer from IC Austria GmbH, Muthgasse 19, 1190 Vienna (referred to in the following as “THE FIZZ Vienna”). Every THE FIZZ Vienna resident is free to recommend THE FIZZ Vienna to any relatives, friends and acquaintances (referred to in the following as the “recruited party”) providing they are not themselves residents, former residents, sub-lessees or follow-up tenants of the recommending resident. On concluding an effective contract between the recruited party and THE FIZZ Vienna, a cash pay-out is made to the recommending resident under the following conditions. Only the following conditions of participation apply for taking part in this program. Any deviating conditions are not recognized. 2. Prerequisites for participation In order to participate in the “Bring your Roomie” program, the recommending resident has to fulfill the following prerequisites. -
At the time of the recommendation and conclusion of contract between the recruited party and THE FIZZ Vienna, the resident is an active tenant at THE FIZZ Vienna.

The resident shall only send the recommendation link to recipients he or she knows personally, and shall also ensure that the recipient has consented to the transmission of such electronic messages.

The resident is not entitled to represent THE FIZZ Vienna. The resident is on no account entitled to accept offers on THE FIZZ Vienna’s behalf, or make or receive statements.

THE FIZZ Vienna disapproves of any form of unfair influence. The resident shall refrain from making untrue statements and providing false information about THE FIZZ products, particularly anything regarding contractual conditions. The resident shall refrain from applying any pressure to the recruited party and shall not undertake any other actions which could be deemed illegal or subject the resident and/or THE FIZZ Vienna to any legal risk. With the exception of recommendation e-mails or links, the resident is only permitted to use brands, trademarks, logos and product names of THE FIZZ Vienna if and to the extent that written consent has been provided by THE FIZZ Vienna.

3. Bonus pay-out One prerequisite for participation in the recommendation program and receiving the bonus is sending or personally forwarding the link www.the-fizz.com/roomie. In addition, the full name of the recommending resident is to be stated by the recruited party in the entry field included on the aforementioned linked page. Another prerequisite is that the recruited party is not a resident of THE FIZZ himself or herself, nor a former resident of THE FIZZ, a sub-lessee or a follow-up tenant for the recommending resident. The resident receives cash pay-outs for the customer orders recommended by him or her in an amount depending on the contract concluded between THE FIZZ Vienna and the recruited party. Differentiation is made between two types of contracts:
Students category: -
Contracts with a rental period of 3 months and a cancellation period of one month until the end of the month

Contracts with a minimum rental period until 30th of September or 31st of March of a year
Young Professionals category: -
Contracts with a rental period of 3 months until the end of the month
If the recruited party concludes a contract with a rental period of 3 months, the resident is entitled to a bonus of 50 euros, while the conclusion of a contract with a minimum rental period until 30th of September or 31st of March (Students) results in a bonus of 100 euros. When the recruited party has concluded a legally valid contract with THE FIZZ Vienna and has paid the due one-off payments, such as the deposit and service charge, the recommending resident receives a confirmation e-mail with a PDF attachment from IC Austria GmbH within 2 working days. The e-mail is sent to the e-mail address provided by the resident on his or her respective conclusion of contract. The PDF serves as confirmation of entitlement to the bonus and has to be submitted to the responsible House Manager in printed form along with proof of identity (personal ID, passport or drivers’ license). The bonus entitlement elapses 4 weeks (30 days) after receipt of the confirmation e-mail.

4. Protecting customer information The forwarding of the recommendation link to people who are not personally acquainted with the resident or do not wish to receive a recommendation is prohibited, as is any form of commercial use or exploitation for commercial purposes. In particular, it is not permitted to announce the link to unknown or unspecified groups of people (e.g. through publication in Internet forums, voucher platforms etc.) or use this link as part of affiliate or similar activities. 5. Terminating the “Bring your Roomie” program THE FIZZ Vienna reserves the right to discontinue the “Bring your Roomie” program without stating any reasons or replacing it with another program with reasonable consideration of the respective interests. THE FIZZ Vienna shall announce this with a reasonable period of notice. Further rights remain unaffected by this. In cases of infringement against these conditions of participation, e.g. particularly in cases of misuse as well as material misstatements or THE FIZZ Vienna contacting recruited parties who have not consented, THE FIZZ Vienna reserves the right, without impacting other rights, to exclude said THE FIZZ Vienna resident from the recommendation program. The right to exclude a person from the program also exists in the event of the existence of appropriate objective grounds for suspicion, for the duration of time necessary for an appropriate examination of the facts. Further claims (particularly claims for damages) shall remain unaffected in each case. 6. Changes to the program or conditions of participation THE FIZZ Vienna reserves the right to change or supplement the “Bring your Roomie” program and the conditions of participation to the extent that this is in the interests of ensuring a simple and secure process, particularly if this is required in relation to the prevention of misuse and participants are not disadvantaged contrary to good faith. 7. Final provisions The business relationship is subject to Austrian law. If individual provisions are or become invalid, the validity of the remaining provisions remains unaffected.

Teilnahmebedingungen Prämienprogramm „Bring your Roomie“ 1. Anbieterinformation, Geltungsbereich Das Empfehlungsprogramm Bring your Roomie ist ein Angebot der IC Austria GmbH, Muthgasse 19, 1190 Vienna (nachfolgend THE FIZZ Vienna genannt). Jeder THE FIZZ Vienna Bewohner kann seinen interessierten Verwandten, Freunden und Bekannten (nachfolgend der „Geworbene“ genannt) THE FIZZ Vienna empfehlen, sofern diese weder selbst Bewohner, ehemaliger Bewohner, Untermieter oder Nachmieter des werbenden Bewohners sind. Bei Abschluss eines wirksamen Vertrages zwischen dem Geworbenen und THE FIZZ Vienna erfolgt unter den nachfolgenden Bedingungen eine Barauszahlung an den Bewohner. Für die Teilnahme an diesem Programm gelten ausschließlich die nachfolgenden Teilnahmebedingungen. Abweichende Bedingungen werden nicht anerkannt. 2. Voraussetzungen für die Teilnahme Für die Teilnahme am Bring your Roomie Programm muss der Bewohner folgende Voraussetzungen erfüllen: -
Der Bewohner ist zum Zeitpunkt der Empfehlung und des Vertragsschlusses zwischen dem Geworbenen und THE FIZZ Vienna aktiver Mieter im THE FIZZ Vienna.

Der Bewohner wird den Empfehlungs-Link ausschließlich an ihm persönlich bekannte Empfänger versenden und bei der Versendung elektronischer Nachrichten beachten, dass die Geworbenen dem Erhalt solcher Nachrichten zugestimmt haben.

Der Bewohner ist nicht berechtigt, im Namen von THE FIZZ Vienna aufzutreten. In keinem Fall ist der Bewohner berechtigt, für THE FIZZ Vienna Angebote anzunehmen, Erklärungen abzugeben oder entgegenzunehmen.

THE FIZZ Vienna missbilligt jede Form unlauterer Beeinflussung. Der Bewohner wird unwahre Behauptungen und falsche Angaben über die THE FIZZ Produkte, insbesondere zu den jeweiligen Vertragskonditionen unterlassen. Der Bewohner wird jegliches Ausüben von Druck auf Geworbene unterlassen und auch sonst keine Handlungen setzen, die rechtswidrig sind oder den Bewohner und/oder THE FIZZ Vienna einem rechtlichen Risiko aussetzen könnten. Der Bewohner darf von Empfehlungs-E-Mails oder -Links abgesehen Marken, Warenzeichen, Logos und Produktbezeichnungen von THE FIZZ Vienna nur verwenden, wenn und soweit ein schriftliches Einverständnis von THE FIZZ Vienna vorliegt.

3. Prämienauszahlung Voraussetzung für die Teilnahme am Empfehlungsprogramm und den Erhalt der Prämie ist die Versendung oder persönliche Weitergabe des Links www.thefizz.com/roomie, sowie die Angabe des vollen Namens des Bewohners durch den Geworbenen unter ebendiesem Link im dafür vorgesehenen Eingabefeld. Weitere Voraussetzung ist, dass der Geworbene weder selbst Bewohner des THE FIZZ, ehemaliger Bewohner des THE FIZZ, Untermieter oder Nachmieter des werbenden Bewohners ist. Der Bewohner erhält für die von ihm vermittelten Kundenaufträge Barauszahlungen deren Höhe von der Art des zwischen THE FIZZ Vienna und dem Geworbenen geschlossenen Vertrags abhängt. Dabei wird zwischen zwei Vertragsarten unterschieden:

Bei Abschluss eines Vertrags von bis zu drei Monaten durch den Geworbenen steht dem Bewohner eine Prämie in Höhe von 50 Euro zu, bei Abschluss eines Vertrags bis mindestens 30.09. eines Jahres (Students) eine Prämie von 100 Euro. Wenn der Geworbene mit THE FIZZ Vienna einen rechtsgültigen Vertrag geschlossen, sowie die fälligen Einmalzahlungen, wie Kaution und Servicegebühr, geleistet hat, erhält der Bewohner innerhalb von 2 Werktagen eine Bestätigungsmail mit PDF-Anhang von der IC Austria GmbH. Die E-Mail wird an die vom Bewohner bei Vertragsabschluss angegebene E-Mail-Adresse versendet. Das PDF dient als Bestätigung der Prämienberechtigung und muss dem verantwortlichen House Manager als Ausdruck inklusive eines Identitätsnachweises (Personalausweis, Reisepass oder Führerschein) zur Prämienauszahlung vorgelegt werden. Die Prämienberechtigung verfällt 4 Wochen (30 Tage) nach Erhalt der Bestätigungs-E-Mail.

4. Schutz der Kundendaten Die Weitergabe des Weblinks an Personen, die dem Bewohner persönlich nicht bekannt sind oder die keine Empfehlung wünschen, ist ebenso wie jegliche Form der geschäftsmäßigen Nutzung oder Nutzung in gewerblichem Ausmaß untersagt. Insbesondere ist es nicht gestattet, den Weblink an unbekannte bzw. unbestimmte Personenkreise (z.B. durch Publizierung in Internetforen, Gutscheinplattformen, etc.) bekannt zu geben oder diesen im Rahmen von Affiliate- oder vergleichbaren Aktivitäten zu verwenden. 5. Beendigung des Bring your Roomie Programms THE FIZZ Vienna behält sich vor, das Bring your Roomie Programm ohne Nennung von Gründen unter angemessener Wahrung der jeweiligen Belange einzustellen oder durch ein anderes Programm zu ersetzen. THE FIZZ Vienna wird dies unter Einhaltung einer angemessenen Frist bekannt gegeben. Weitergehende Rechte bleiben hiervon unberührt. Bei einem Verstoß gegen diese Teilnahmebedingungen, wie insbesondere im Falle des Missbrauchs sowie bei wesentlichen Falschangaben oder THE FIZZ Vienna Kontaktierung von Geworbenen, die einer solchen nicht zugestimmt haben, behält sich THE FIZZ Vienna unbeschadet sonstiger Rechte vor, die jeweiligen THE FIZZ Vienna Bewohner vom Empfehlungsprogramm auszuschließen. Das Recht zur Sperrung besteht auch im Falle des Vorliegens entsprechender objektiver Verdachtsmomente, für die Dauer des Zeitraums, der zur angemessenen Prüfung des Sachverhaltes erforderlich ist. Weitergehende Ansprüche (insbesondere Schadensersatzansprüche) bleiben jeweils unberührt. 6. Änderungen des Programms oder der Teilnahmebedingungen THE FIZZ Vienna behält sich vor, das „Bring your Roomie“ Programm und die Teilnahmebedingungen zu ändern oder zu ergänzen, soweit dies im Interesse einer einfachen und sicheren Abwicklung, insbesondere zur Verhinderung von Missbrauch erforderlich ist und die Teilnehmer hierdurch nicht wider Treu und Glauben benachteiligt werden. 7. Schlussbestimmungen Die Geschäftsverbindung unterliegt österreichischem Recht. Sollten einzelne Bestimmungen unwirksam sein oder werden, so wird dadurch die Wirksamkeit der übrigen Bestimmungen nicht berührt.
